Spring Into Fitness Sweepstakes

OFFICIAL RULES

NO PURCHASE REQUIRED or NECESSARY to enter or win. This Spring Into Fitness Sweepstakes is open to legal U.S residents who are 18 years of age or older at the time of entry. The decisions of the PURE FITNESS LLP. (hereafter the “Sponsor”) are final and legally binding in all sweepstakes related matters.

1. ELIGIBILITY: Open to legal residents of the State of Arizona who are eighteen (18) years of age and only upon their first visit to a Pure Fitness location. Void where prohibited by law, rule or regulation. This promotion is governed by US law and is subject to all applicable federal, state, and local laws, rules and regulations. Members of Sponsor, employees of Sponsor, their respective parents, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and members of the immediate family or household of each are not eligible to participate.

2. PRIZES/ODDS: One (1) Grand Prize will be awarded in the form of a $1,500 travel voucher from Terra Travel to be used for airfare from the nearest major airport located closest to the winner’s home address and/or hotel accommodations. Total Approximate Retail Value of the Grand Prize Package $1,500 ALL EXPENSES, TAXES AND COSTS ASSOCIATED WITH ACCEPTANCE AND USE OF THE PRIZES NOT SET FORTH IN THESE RULES ARE THE OBLIGATION OF THE
WINNER. Odds of winning depend on the total number of eligible entries received. Grand Prize Winner and any travel companions must have appropriate identification to travel within the US, and must travel at the same time and on the same itinerary, as specified by Sponsor in its sole discretion. No assignment, transfer or substitution of prize is permitted. All travel will be booked through Terra Travel and may not be changed or altered once confirmed. Travel may be on any date to be determined by the prize winner. Sponsor reserves the right to provide a substitute prize of equal value, or provide a different form of compensation of equal value, if any, in its sole discretion. No cash alternative prize is offered.

3. ENTRY: Sweepstakes begins on Monday, April 7, 2008 at 12:00:01 a.m. (“MST”) and ends on Saturday, May 31, 2008 at 11:59:59 p.m. MST ("Promotion Period "). To enter visit www.purefitnessclubs.com/membership/freepass, print out the free 30 day guest pass and Come to the nearest Pure Fitness location to start your 30 day free membership. LIMIT: One entry per person. Sponsor may reject any entry it believes is the result of fraud or was redeemed in violation of these Official Rules.  ACTIVATION: To fully comply with the process of activating the 30 day free membership the entrant must accompany a Pure Fitness representative on a full tour of the facilities and amenities.

4. DRAWING: The random drawing will take place on or about June 1, 2008 from all eligible entries received during the Promotion Period and will be under the control of PURE FITNESS LLP. ( the “Sponsor”), whose decisions are final and legally binding, as they pertain to the Sweepstakes. The potential winner will be notified by email, telephone, overnight carrier, or regular mail within approximately three (3) days of the drawing. If Sponsor is unable to contact the potential winner after reasonable effort, or if potential winner fails to respond within seven (7) days of first attempted notification, prize will be forfeited and awarded to an alternate winner from among all remaining eligible entries.

5. GENERAL: The potential winners may be required to sign and return an Affidavit of Eligibility, a Liability Release, and/or, a Publicity Release, in order to receive the Prize. In the event of noncompliance with these requirements, the potential winner may be disqualified and an alternate winner selected, at Sponsor’s discretion. Acceptance of prize constitutes permission for Sponsor and their respective affiliates and related companies to use winner’s name and likeness in any and all media, now known or hereafter devised, without notice, review or approval, in perpetuity and throughout the universe for advertising and promotional purposes without additional compensation or consideration, unless prohibited by law. By entering, you release and hold harmless Sponsor, Judges and each of their respective parents, subsidiaries, affiliates, directors, officers and employees and agents from all liability or any injuries of any kind arising from or in connection with participation in this sweepstakes or acceptance, travel or use of any prize. By entering, you agree to abide by these Official Rules and the decisions of the Judges regarding this Sweepstakes, which are final and binding in all respects. Sponsor awards the prize WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. All disputes will be resolved under applicable U.S. laws.

6. INTERNET: If, for any reason, the Internet portion of this promotion is not capable of running as planned, whether due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. In the event of termination, a random drawing to award the Grand Prize will be conducted from all valid entries received up until the time of termination. Sponsor and the Judges assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, or incomplete entries. Sponsor and the Judges are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND JUDGES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
